Sorry, but this annoys me. 1st, if M$ doesn't have it in their EULA that they're capable of recording and they do it anyways, a single whistleblower sends all their executives to jail. So if it's possible through M$ software, it'll be in the EULA. Verizon's EULA says they reserve the right to record things, and a government order forced them to. And if it is in the EULA, just like Origin's data mining was, people will find it and there will be an outrage over it and they'd have crippled themselves until they remove it, at which point it goes back to executives risking jail time. 2, If M$ doesn't have the infrastructure set up, the government can't force them to set it up. That infrastructure is insanely expensive to maintain, prohibitively so. The verizon stuff was just recording what was already going through the network. For the Kinect to actually report anything back to M$ they'll require extreme amounts of additional bandwidth that will severely impact those with capped internet, shutting out a massive portion of the US market from Microsoft's audience. Third thing, M$ has already said you can turn off EVERY SINGLE FEATURE of kinect. Yes, you can't disconnect it, but that's because the OS is designed to check for it. Same way games automatically pause when no controller is detected.
I don't think they keep a copy of your files. If they did, you'd spend a lot of time uploading data, which would juice your bandwidth. They probably keep track of sites you visit, files you download, emails you send, etc.

Behold: An achievement for being stupid enough to preorder the Xbone*. *I'm not calling anyone stupid for wanting the Xbone. I'm just calling people stupid for buying it before MS fixes all the launch issues that will happen because if those launch issues mean the servers don't work, your Xbone won't work either. The PS4 doesn't need any servers to operate, so it will still work when the servers don't.

If you don't get an Xbone before MS fixes the launch issues, then this "free to play" game will be unplayable until you pay because there are no free characters. The pay to win model that many of us complain about is an improvement over this.
PS4 all the way. Just preordered it from Amazon today, since it was cheaper than local shops for whatever reason. I wish I had ordered it earlier from a local shop, where they had it listed at £70 cheaper than the amazon prices. But they changed it when Sony announced the actual price.
I'm the biggest Killer Instinct fan. Terrible article, but I just can't get excited at the prospect of another KI game, knowing it'll be on the Xbox One.

Jeff from Giantbomb basically said it right last night on their show, they (microsoft) are putting certain people in a bucket that will spend lots of money on their digital stuff and services and don't care about things like ownership of the things they buy and telling everybody outside that bucket that they are not interested in their business. That includes places like Japan where they don't sell enough consoles to bother with anymore. Sony is saying "we got something for everybody no matter where you live or how much disposable money you have."
The Xbox has never done well in Japan. The situation in Europe is more interesting. Some EU countries get the Xbone, others don't. I wonder what EU laws say about adding artificial barriers to trade within the EU.
CD Projekt RED is a polish developer. Known for the Witcher series. Poland is a country where the Xbone will not work. The Witcher 3 was one of the games MS showed during the Xbox conference. Games need lots of testing before release. How are CD Projekt RED going to handle testing the Xbone port of The Witcher 3 when they can't use an Xbone in their country ?
